1.1 This is the Privacy Statement of the websites of Electude International B.V. as well as its affiliates or subsidiaries (hereinafter: “Electude”, “us” or “we”). Electude is responsible for the processing of your personal data when you use our website. This Privacy Statement describes how this data processing takes place and for what purposes these data are processed.

1.2 By using the websites of Electude, you agree to the following terms and conditions that apply to it. If you do not agree with this Privacy Statement, you are requested not to use the websites of Electude.

 

2. Purpose, data and retention period
2.1 Electude processes the following personal data from visitors on our website, for specific purposes only:

  • Data: When you choose to receive news and updates about our products,     Electude processes the following personal data for the purpose of sending             newsletters:
    • Contact details: First- and second name, email address, gender, language preference, job title
    • Organisation details: Name, type, address and region.
  • Legal grounds: Electude processes these data on the basis of consent, which means that we only process these data in order to send you our newsletters when you give us permission to do so. In these newsletters you are provided with an option to retract your consent, a so called “opt-out”, which will directly terminate our newsletter service.
  • Retention period: The data will be retained as long as required to deliver the service and will be destroyed two years after the service is terminated, unless legal obligations require us to keep it longer.

2.3 Forms

  • Data: When you choose to fill in a form on our website in order to receive a free trial of our products or to sign up for a webinar, Electude processes the following personal data:
    • Contact details: First- and second name, email address, gender, language preference, job title
    • Organisation details: Name, type, address and region.
  • Legal grounds: Electude processes these data on the grounds of performance of contract and legitimate interest. The data will be retained for a certain period, depending on the specific type of form you filled in.
  • Retention period: We keep this information as long as required to deliver our services and perform our contracts. Then we destroy it, unless legal obligations require us to keep it longer.

2.4 Commercial targeting

  • Data: When you accept the tracking cookies on our website, Electude will process the following  personal data for the purpose of tracking potential customers:
    • Device type, browser type + version
    • Search engine type + key words used in search engine
    • Language preference, country
    • IP-address
    • Time, date
    • Time spent on website
    • Website route/funnel
  • Legal grounds: Electude processes these data on the basis of consent, which means that we only process these data in order to personalize our website experience when you give us permission to do so. If you choose to remove/block the tracking cookies, we will (no longer) process these data for this purpose.
  • Retention period: These data will be retained for one year, after which they will be destroyed, unless legal obligations require us to keep it longer.

2.5 Website improvement

  • Data: When you visit our website, Electude will process the following (anonymous) personal data for the proper functioning and improvement of our website in order to provide you with the best experience:
    • Device type, browser type + version
    • Search engine type + key words used in search engine
    • Language preference, country
    • IP-address
    • Time, date
  • Legal grounds: Electude processes these data on the grounds of legitimate interest. The processing of these data is needed to improve our services.
  • Retention period: These data will be retained for one year, after which they will be destroyed, unless legal obligations require us to keep it longer.

 

3. Automated decision-making
3.1 Electude does not make decisions which can have (severe) consequences for people based on automated decision-making.

 

4. Transfer to third parties
4.1 Only the parties authorized by Electude to protect and/or otherwise process personal data and/or perform IT maintenance activities have access to your personal data.

4.2 For the purpose of processing personal data as stated under article 2 Electude has engaged several processors. Processing by these processors is governed by a contract which stipulates, in particular, that the processors assist Electude with appropriate technical and organizational measures for processing of personal data.

4.3 For the rest, Electude will not provide your personal data to third parties, unless this is necessary for the performance of its services, under a statutory provision or in case of an emergency, insofar as this is in your interests in the reasonable opinion of Electude.

 

5. Cookies

6. Social Plugins
6.1 On the Electude websites Social Plugins of different social networks e.g. YouTube LLC (“social networks”) are integrated. These allow you to bookmark and share the Electude websites with other participants in the social networks. For the purpose and scope of the data collection and further processing and use of your data by the provider as well as your related rights and opt-out possibilities to protect your privacy, please see the privacy policies of the respective social networks.

6.2 The social networks may provide the information collected via their cookies to third parties if they are legally obliged to do so, or insofar as these third parties process the information on behalf of (one of) them. The information is transferred to and stored on servers in the United States. The social networks agree to comply with the privacy regulations that apply there. This means that there would be an appropriate level of protection for the processing of (personal) data. Electude is not responsible for this and excludes all liability in this regard.

 

7. Your rights with regard to the collected data
7.1 You have the right to access your data. For this purpose, you can ask Electude what data are registered and what they are used for. Please find our contact details in article 10 of this statement.

7.2 You have the right to have the data Electude collects from you corrected, changed or supplemented if these are incorrect or incomplete. Please find our contact details in article 10 of this statement.

7.3 You have the right to ask who has access to your data. You can ask Electude what data are registered and who has/has had access to them. Please find our contact details in article 10 of this statement.

7.4 In certain legal instances, you have the right to have your data erased. This possibility may be restricted by statutory or contractual requirements or obligations.

8. Security
8.1 Electude has implemented appropriate technical and organizational measures to protect personal data against loss or unlawful processing:

  • All data are transmitted over a secure connection (via the HTTPS protocol).
  • Passwords are salted and hashed before storing them.
  • The servers are secured by a firewall.
  • The service is by an ISO 27001 certified provider.

8.2 In addition Electude uses CloudFlare as an extra security layer. When you visit Electude’s website, you send data to Electude’s servers and receive data from Electude’s servers though the nearest CloudFlare server. CloudFlare processes data (such as traffic data) to provide and improve it’s service. For more information see their privacy policy.

8.3 Despite the fact that Electude has taken and will take all possible security measures, the processing of your personal data via the Internet involves risks that are inherent to the use of the Internet in the public domain.

 

9. Changes
9.1 Electude reserves the right to change this Privacy Statement. In case of a material change, users of our services will be requested to accept the new Privacy Statement on continued use of the services.
